Limitation of Liability and Indemnity
We do not accept any liability howsoever arising in regard to the lawfulness or otherwise in regard to your website you want us to design for you. All legal formalities are entirely your responsibility and the website is set up according to your instructions at your sole risk in the above regard. You hereby indemnify us against any claims howsoever arising from the website or its content being unlawful or failing to comply with relevant legislation.
You agree to further indemnify us against any copyright claims for images that are approved by you for use in any graphic or website related work.
Copyrights and Trademarks
WordPress Web Services is not responsible for the images and content published on the designed websites. It is the client’s responsibility to ensure that all images, fonts and content published on their website conform to Copyright Laws. If any of the images and content are not lawfully owned or licensed by the website owner, explicit permission to use them must be obtained by the client.
Client Delays & Refunds
Website subscription payments are not refundable under any circumstances. After a subscription is made, it is the clients’ responsibility to send the required content within a reasonable timeframe. WordPress Web Services will not be held liable for any delays from client’s side. Any delay by the Client will result in a day-for-day extension of the due date for all Deliverables. Unless otherwise expressly agreed, it is the client’s responsibility to provide all content (written copy, images, videos etc.) in order to create the website. This must be supplied within a reasonable time-frame, ideally within 1-4 weeks of project commencement. Delays in supplying all content required to complete the site will result in the development being put on hold.
Website Transfers
WordPress Web Services hosts websites on behalf of clients as long as monthly subscription is paid. Should the client wish to transfer website files over to another hosting provider within the first 72 months of subscription, the following fees will apply:
– Standard Packages: R4 000 payment required upfront in order to release web files
– E-Commerce Packages: R6 000 payment required upfront in order to release web files
Should client wish to transfer only domain name, an hourly fee will be charged dependent on requirements.
Should client wish to transfer website over to new hosting provider after 72 month subscription period, an hourly fee will be charged dependent on requirements.
In the event that client only wants to transfer their domain name over to the same hosting provider used by us, client accepts that a waiting period of 2 weeks is applicable, in addition web files are deleted during this waiting period.
Payment Failure
Web Subscription Clients
Should WordPress Web Services receive a subscription payment failure (out of funds, or any other payment error) from clients subscription, clients web files and hosting will be suspended with immediate effect and will remain suspended for a total of 48 hours after debit is successful. Client will be notified about the issue within 24 – 48 hours. If the issue is not resolved within a maximum of 4 days or WordPress Web Services receives no response from client on the matter, clients website hosting shall be terminated. In addition, client accepts that website files will be irretrievable after this period as server backups are only kept for 4 days.
Cancellation
Client is free to cancel their Payfast subscription at any given time. Upon cancellation, clients hosting (website + emails) will be terminated with immediate effect.
In the event that client changes their minds and wishes to resubscribe, this needs to be done within no longer than 3 days of cancellation in order to restore web files. Client accepts that any web files will be irretrievable after this period as server backups are only kept for 3 days.
Should client wish to receive their web files, client needs to notify WordPress Web Services before cancelling hosting. The fees outlined above under “website transfers” are then applicable.
Downtime
WordPress Web Services does not guarantee 100% website uptime. As websites are being hosted by a 3rd party hosting provider, client acknowledges that there may be occasional downtime for web maintenance, etc. which is beyond our control.
Cpanel & FTP
WordPress Web Services does not under any circumstances provide clients with Cpanel or FTP details.
